13. Shipping, delivery, and customs duties

Delivery times shown at checkout or in confirmation emails are estimates and not guarantees. We are not responsible for delays caused by carriers or customs authorities.

Prices shown at checkout do not include customs duties, import taxes, brokerage fees, or any other charges imposed by your destination country customs authority. These unexpected costs, if any, are the sole responsibility of you, the customer, and must be paid to the carrier or the customs authority before delivery can occur. We do not control these charges and cannot predict the amount.

If you refuse to pay customs duties or taxes and the parcel is returned to us, we will treat the order as a returned order. Any refund will be net of the original outbound shipping costs, any return transportation charges, and any customs duties, taxes, or handling fees charged to return the parcel to us.

We are not responsible for any loss or damage after delivery has been confirmed by the carrier. For shipments requiring a signature, delivery occurs when the carrier records a successful delivery scan at the address provided.

If an order is refused by the customer, not accepted upon delivery, or returned to us because an incorrect address was provided, the original shipping costs and any return shipping costs will be the responsibility of the customer. These costs may be deducted from the refund amount.

14. Order cancellation

If you contact us straight away after ordering via hello@dandelie.com, we may be able to cancel your order before it is processed. If your order is already processed, we are not able to cancel your order.

We charge a cancellation fee that ranges from 1 percent to 10 percent, depending on your payment method and currency.

15. Returns and exchanges

Please see our Return Policy for the full process and eligibility rules. The following terms apply in addition to that policy.

Unless the product is faulty, damaged, or not as described, or unless mandatory law requires otherwise, you are responsible for the cost of returning items to us. Return shipping costs are not refundable.

For international returns, customs duties, import taxes, and processing fees that arise when sending goods back to the Netherlands are your responsibility. If we are charged any such amounts by the carrier or customs during the return process, we will deduct those amounts from your refund. To avoid extra charges, you must follow the return instructions we provide, including correct paperwork and labeling as a customer return.

If a return is not eligible for a refund under our Return Policy, we may either send the item back to you at your cost or hold it for a limited time for collection.

16. Disclaimer of warranties and limitation of liability

We do not guarantee that your use of the Service will be uninterrupted, timely, secure, or error free. We do not warrant that results obtained from the Service will be accurate or reliable. In no case shall Dandelie, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, whether based in contract, tort including negligence, strict liability, or otherwise, arising from your use of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content or product posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in those jurisdictions our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Dandelie and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

If any provision of these Terms is unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. This determination shall not affect the validity and enforceability of any other remaining provisions.
